General Terms and Conditions of Sale for Consumers or End Users
- Definitions.
“You” or “Client” or “consumer” is natural or legal person who purchases or uses the Products or acquires Products for his or her own use or that of his or her family or social group or company.
“We” or “ACERO LOZA Y CRISTALERIA GYR SA DE CV” “GRUPO ALAKARTA” or “the company” or our legal representative, any of its affiliates whose name appears on the invoice, domiciled at the address indicated on the invoice and, where applicable, the Service Provider.
“Order Confirmation” document by which GRUPO ALAKARTA accepts an order for Products. It can also be the invoice with the company's RFC.
“Price” price indicated in the Order Confirmation.
“Product” means the good or service described in the Order Confirmation, which may include Third Party Products and Service Offerings.
“Third Party Products” are products described in the Order Confirmation that are not manufactured by GRUPO ALAKARTA or branded ALAKARTA, and another brand or Manufacturer is specified.
- Scope of Application.
These General Terms and Conditions of Sale are applicable to any and all sales of Products and/or services made by GRUPO ALAKARTA within the Mexican Republic, whether they are Products promoted or included in any of their forms, in our brochures, promotions, price lists, advertisements, budgets, on the Internet or verbally. Any other terms or conditions that may replace these are excluded. Placing an order implies your express acceptance of these General Terms and Conditions of Sale.
- Order.
Orders will be accepted in writing, by email, telephone or fax and will only be binding once the company issues a sales note or invoice using any of the means of communication described above. You must check the Order Confirmation and notify us immediately in writing of any errors. Otherwise, the description of the Product in the Order Confirmation will become part of this document and will be binding on the parties.
- CANCELLATION POLICY :
In the event that your purchase or order is cancelled:
- The customer has the right to receive a refund, without charges or penalties, equivalent to 100% of the payment made. The refund must be applied through the same payment method used in the case of using electronic means, and if this is not possible, through a bank deposit in the name of the customer who made the purchase. A refund can only be requested on the same day of the payment transaction or product purchase.
- In case of cancellation, the company is not obliged to provide an item or service similar to the one cancelled.
Purchases may be cancelled by the company for any of the following reasons:
- In case the product is out of stock.
- In case the product is no longer offered by the company.
- In case the product is discontinued.
- In case of typographical errors
- In case of obvious errors in the price of the product.
- In case of human errors in the price and offers on products.
- In case of an error in the offer.
- In the event that the company determines that it does not have sufficient stock to fulfill an order.
- In the event that the order or estimate made through this means is not paid within the first 24 hours of being generated.
- In the event that payment is not notified in writing within the first 24 hours of the order being generated.
- The customer may cancel their purchase without penalty for orders that have not yet been shipped, have not been delivered, have not started manufacturing and have not been ordered from the supplier in the case of brands other than GRUPO ALAKARTA.
- For all brands other than GRUPO ALAKARTA and the order for a product is lifted, the cancellation applies a 100% charge of the value of the advance or payment provided.
- Once the purchase has been shipped or delivered, we do not accept changes or returns.
ALL PRICES ARE SUBJECT TO CHANGE WITHOUT NOTICE
No purchase will be considered successful, nor will any product be delivered until the firm payment is reported in our bank account, and until the customer receives direct confirmation from ACERO LOZA Y CRISTALERIA GYR SA DE CV in their email. NO EXCEPTIONS.
Every order, even after receiving confirmation of purchase, is subject to our CANCELLATION POLICY. For any of the reasons mentioned therein.
- OTHER PROVISIONS:
No claims are accepted for bumps, breakages, or missing parts; it is the customer's responsibility to check upon receipt. You accept receipt of the user manual and warranty. Prices do not include installation, which are at the buyer's expense and risk. The warranty is invalid when operated differently than indicated in the user manual. The warranty is invalid when opening the equipment, repairing it, or providing service not authorized by us. To make your warranty valid, you must show documents proving that it was installed by trained personnel. 1-year warranty against manufacturing defects in cooking equipment. There is no warranty on electrical parts. If another duration is indicated, the shorter duration will be valid. Utensils and accessories are not guaranteed; the warranty does not include: wear, misuse, electric shocks, or poor installation. Warranties do not include shipping costs. We are not responsible for damages caused to third parties, whether to their persons, personal property, or real estate caused by the equipment, utensils, or installations required by the equipment purchased from us. ALL PRICES ARE WHILE SUPPLIES LAST AND ARE SUBJECT TO CHANGE WITHOUT NOTICE. WE RESERVE THE RIGHT TO CANCEL ORDERS IN THE EVENT OF OUR SYSTEM ERRORS DUE TO OUT OF STOCK, TYPOGRAPHICAL ERRORS, OBVIOUS PRICING ERRORS, HUMAN ERRORS IN PRICING AND OFFERING, COMPUTATIONAL FAILURES AND/OR ERRORS, HUMAN FAILURES AND/OR ERRORS, FAILURES AND/OR INFORMATION PROVIDED, FAILURES AND/OR OF OUR DISTRIBUTORS AND/OR SUPPLIERS.
IN CASE OF ANY MISSING ITEMS IN YOUR ORDER:
You must notify the customer service team within the first 24 business hours, reporting exactly what is missing and including photographs as evidence of what you have received.
After 24 hours, it is not possible to make a claim if there is any missing item in your order.
THE MERCHANDISE IS LAB GUADALAJARA JALISCO MEXICO, IT TRAVELS AT THE EXPENSE AND RISK OF THE BUYER:
If you receive damaged merchandise, you must contact the contracted shipping, freight or courier service to request repair or replacement directly from said provider.
Once the merchandise has been received and signed, you are accepting that the merchandise has been received in perfect condition and under your approval.
